What counts as car-pooling
LTA describes a car-pool service as a private-car owner offering a commuter a lift in the private car to a destination along the driver's way. LTA says car-pool drivers may accept no more than 2 trips a day and charge fees to recover their cost (LTA, Point-to-Point Travel Options).
The Road Traffic (Car Pooling — Exemption) (No. 3) Order 2021 defines a car-pooling arrangement more narrowly: carrying one or more passengers must be incidental to the journey's main purpose, and the driver would have made the journey anyway. It must not result from the driver or another person standing or plying for hire on a road, parking place, or public stand. The consideration is limited to the passenger's share of journey costs, with no profit made by the driver or another person, or a reciprocal similar journey or similar benefit (Singapore Statutes Online, Road Traffic (Car Pooling — Exemption) (No. 3) Order 2021, r. 2).
Conditions for the private-car exemption
The Order exempts an individual driving a private motor car from specified public-service-vehicle requirements only when the car-pooling arrangement meets its conditions. The driver may carry passengers on no more than 2 journeys each day; an approved on-demand ride-booking service must directly match the driver and passenger for a journey or part of a journey the driver would make anyway. Before the carriage starts, the passenger must be told the driver's destination, and the date, pickup and drop-off points, and payment (cash or in kind) must be agreed. The private car must not display fares for hiring it (Singapore Statutes Online, Road Traffic (Car Pooling — Exemption) (No. 3) Order 2021, r. 3).
For counting the daily journeys under this exemption, a journey starts when the first passenger for hire or reward is carried during the driver's trip to the destination disclosed to the passenger. It ends when the car reaches that destination (Singapore Statutes Online, Road Traffic (Car Pooling — Exemption) (No. 3) Order 2021, r. 3(3)).
The exemption is limited to the specified Road Traffic Act public-service-vehicle licensing and conduct requirements listed in the Order. It is not a general exemption from other laws. For example, the separate compulsory motor-insurance requirement continues to apply; see compulsory motor insurance (Singapore Statutes Online, Road Traffic (Car Pooling — Exemption) (No. 3) Order 2021, r. 3(2)–(3); Motor Vehicles (Third-Party Risks and Compensation) Act 1960, s. 3).
The Order also exempts the private-car owner and another person who causes the qualifying car-pool use from only the particular Road Traffic Act requirements named for them. Those exemptions apply only to the qualifying arrangement and driver described in the Order (Singapore Statutes Online, Road Traffic (Car Pooling — Exemption) (No. 3) Order 2021, rr. 4–5).
LTA's PHC FAQ separately says that drivers with a valid Taxi Driver's Vocational Licence (TDVL) or Private Hire Car Driver's Vocational Licence (PDVL) may use a chauffeured PHC for car-pooling trips (LTA, FAQs for Private Hire Car Matters, Q36).
Car-pool service operators
LTA says a point-to-point operator must apply for and receive a Car-Pool Service Operator Licence (CSOL) to operate if it provides car-pooling services and has 800 or more vehicles on its platform. LTA lists a non-refundable $2,500 application fee for each CSOL or Ride-Hail Service Operator Licence application (LTA, Taxi & Private Hire Cars). This operator threshold is separate from the conditions that apply to an individual driver's car-pooling arrangement.
Coverage debt
- The Order's exemption conditions are specific to arrangements matched through an approved on-demand ride-booking service. The sources cited here do not fully explain how every unpaid or privately arranged lift between friends, family members or colleagues is treated under other provisions; this article does not extend the exemption to those cases.
- LTA's operator page gives the CSOL application contact and fee but does not reproduce the full application process or all licence conditions.
